1 Acceptance of Terms
By accessing or using the Service, you confirm that you can form a binding contract, that you accept these Terms, and that you agree to comply with them. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2 The Service
FlameOS provides an AI-assisted business operating system including CRM, email and calendar integration, marketing automation, and related workflow tooling. We may add, change, or remove features over time. Some features depend on third-party services you choose to connect (such as Google), and those features are subject to the third party's own terms.
3 Accounts & Registration
- You must provide accurate information and keep your account credentials secure.
- You are responsible for all activity that occurs under your account or deployment.
- You must promptly notify us of any unauthorized use or security breach.
- You are responsible for ensuring you have the rights and consents needed for any data you import, connect, or process with the Service.
4 Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation, or infringe the rights of others.
- Send unlawful, unsolicited, or deceptive communications ("spam"), or otherwise violate anti-spam, telemarketing, or electronic-communications laws (e.g., CAN-SPAM, GDPR/ePrivacy, TCPA) where they apply to you.
- Transmit malware, attempt to gain unauthorized access, or disrupt the Service or others' systems.
- Access or process data you are not authorized to handle, or misuse data obtained through connected services.
- Reverse engineer, resell, or sublicense the Service except as expressly permitted by your license or a separate written agreement.
We may suspend or terminate access for violations of this section.
5 Third-Party Services & Connected Accounts
When you connect a third-party account (for example Google Gmail or Google Calendar via OAuth), you authorize the Service to access that account to provide the features you enable, as described in our Privacy Policy. Your use of those third-party services remains subject to their respective terms and policies. We are not responsible for third-party services, and you may disconnect them at any time.
6 Self-Hosted Deployments
FlameOS is designed to run on infrastructure you control. Where you self-host the Service, you are responsible for provisioning, securing, updating, and maintaining your servers and environment, for backups, and for compliance obligations relating to data you store there. We provide the software and, where agreed, support; we do not control or guarantee the availability of infrastructure you operate.
7 Intellectual Property
The Service, including FlameOS software, branding, and documentation, is owned by B2B Growth Systems and its licensors and is protected by intellectual-property laws. Subject to these Terms and any license you hold, we grant you a limited, non-exclusive, non-transferable right to use the Service. Your data remains yours; you grant us only the limited rights needed to operate the Service for you.
8 Disclaimer of Warranties ("As Is")
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES. YOU ARE RESPONSIBLE FOR REVIEWING OUTPUTS BEFORE RELYING ON THEM.
9 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, B2B GROWTH SYSTEMS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10 Indemnification
You agree to indemnify and hold harmless B2B Growth Systems and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your data, or your violation of these Terms or applicable law.
11 Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive. Where the Service is self-hosted, you remain responsible for your own deployment and data after termination of any agreement with us.
12 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13 Governing Law
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-laws rules.
